    Default Will Charges be Filed from an Unemployment Fraud Investigation

    A worker in Maryland was contacted by the Maryland Unemployment Division for Fraud. They received a report that he was employed while collecting UI benefits. He got a part-time job and did not report the employment to them. His overpayment is roughly $8,000. What are the chances that he will be criminally charged?

    We can't realistically state his chances -- that's best done by a criminal defense lawyer who knows the agency policies, the local prosecutor's policies, and the full facts of the case. However, given those facts, he should lawyer up -- following his lawyer's advice on repayment of the money and using his lawyer to communicate with any investigative agencies. Any statements he makes can be used against him in future civil and criminal proceedings.
