    Exclamation Can You Change a Child's Last Name Before Paternity is Established

    My question involves paternity law for the State of: ohio

    My son is only 10 days old fyi.

    i put my bf last name on my son on just the social security card, bc we were hoping it would be he's. but since my son is a couple days old he doesnt look like my bf, he looks like my ex from before. ( messed up story)
    since then we broke up but still friends but i am going after the guy who is my sons father thru child support.
    but anyways is there any easy way to change my sons last name to just my last name since since i am hes mother?
    No one has signed the birth certificate, as the father.
    i know if my ex that is the father goes thru the whole child support stuff, would he be allowed to sign our sons name?
    either way i want the easiest way to change my sons last name and the cheapest.
    i prefer my last name bc there was no men born to carry on my fathers last name, but i would hate to leave the 1st guys last name as my sons bc they are not related.

    Do you have an actual DNA test showing the thought-to-be-dad isn't dad? Looks are not always going to be a good indicator of parentage. Does Might-be-dad think he might be dad too?

    In your other thread you indicated that your boyfriend signed an AOP and is the child's legal father. ("...he knew she was not his and signed the birth certificate and stuff....") Did he rescind the AOP in a timely manner?

    You can't determine paternity based on looks. Did you get a DNA test done on BOTH the possible fathers? That might be the first step you do. Which one is legally the father?

    Why didn't you just give him your last name to start with? First you need to find out who the actual father is and not just assume. Guess what? My ex's older daughter looks exactly like her mom and only just started to look like him a little. Some people look more like one parent than the other. Some kids don't look like either parent. One of my friend's daughters looks nothing like her mother or her father. Just saying.

    We're not biologically related to our girls .. and yet we've both been told (and not infrequently, either) that the eldest looks like me and the youngest looks like him (and vice versa, naturally).
