    Default What to Do if You Arrive Late for a Weekend in Jail

    A defendant convicted of DUI in Virginia was given a jail sentence to be served on weekends. The defendant arrived at the jail 45 minutes late for the start of his weekend time. The jail would not let him in. What should he do?

    He should immediately contact his criminal defense lawyer. He needs to arrange to present himself before the court services / offender services agency (CSOSA), with a very good explanation of why he was late. If the defendant wants to avoid being resentenced to a standard jail sentence, and still be allowed to serve on weekends, it is not a good idea to try to talk his way out of the situation without the help of a lawyer.
