Get a lease agreement, whether for a term (e.g. a year) or month-to-month, that is valid for your state. Prepare it for presentation to your tenant.
Give your tenant notice that their 'free' tenancy is ending, consistent with the laws of your state to terminate a residential tenancy. Make sure that your notice is in proper form, and is properly delivered to your tenant, consistent with state law.
At the same time, present them with the option of entering into a lease, presenting the lease that you have prepared.
During the next few weeks, make any necessary repairs to the property, and make sure you have any required permits in place, so that you can legally rent out the property.
If the occupants decide to sign the rental agreement, you can start charging them rent in the amount stated in that agreement. If they decide not to pay rent, commence eviction proceedings in court.
