    Default Can You be Prosecuted for Theft Over a Bank Error

    If a bank processes a check incorrectly, and you take the extra money out of your account, can they prosecute you for theft or fraud?

    Depending upon the reason that the mistake occurred, how much money is involved, and the laws of the state in which this occurred, there's a definite possibility.
