    Default Child Support and Custody Change

    Hello, I live in Florida. My x owes over $28,000 child support in arrears and behind on $2,800 current child support. He is trying to get custody of 16 year old child. If child does go to live with him, I guess that means I would have to pay him child support? My question, would that amount be deducted from his arrears or would I actually have to pay? I don't think I will ever get money he owes from many years. The above figures don't count interest or medical expenses he was supposed to reimburse. All in all he owes me around $60,000.
    I have mostly raised 2 children on my own for 12 years. One child is now grown.
    Thanks in advance for any information regarding how the courts will calculate if indeed a custody change occurs.

    I guess it depends. Why would you, at this point, allow your child to change residences?
    Because the need for current support is more important than the need for arrearages, you would probably owe. However, since it appears that you would both have custody of 1 child (I'm guessing both children are under this same order), the current support amounts would be similar enough so that only 1 of you (the person who owes the other the most money) would be paying support to the other.

    Why isn't support being taken out of his check? Why haven't you filed for contempt?

    He is self employed and child support has been very difficult to enforce all along, since 1994. Courts have forced him to pay a purge from time to time or face going to jail. This has worked in past, but he continues to not pay until he is taken to court again. Now with 16 year old he has manipulated the child to stay with him. Divorce settlement states my home as residence of the child but that we have joint parental responsibility for child. I cannot discuss any issues with x about problems with teen - he always sides with my son, does not enforce any rules.
    He does not make child go to school. I have tried to talk with him - and he says he is not going to make son go to school if he does not want to. I refuse to call my son in sick from school when he is not sick, but father continues to call son in sick repeatedly. Child is not sick, and is even out running around with other teens during school time. Son missed over 90 days first semester and over half of the time either late or not in school at all since Jan. Father tells son not to listen to his mom. Now x has attorney and is saying child has lived with him for the past 5 years. We only live a few blocks apart. Sorry for all the details, this is complicated. I have the Florida Department of Revenue Child Support Services helping me, but I don't think they can help with custodial issues. Seems crazy that I should have to apply for sole custody of child of 16 YOA. I don't know what to do. I am worried about my sons well being and my x who would do anything for money. Child has very high FCAT test scores and is very bright. However, he is now failing since father tells son he can stay there anytime, allows him to run around all night, often does not know where son is and calls him in sick. If I try to make any rules son just runs to Dad that lets him do whatever. I don't know what to do. I am going to talk with school truancy officier next week regarding this case. School and all records list me as custodial parent.
