    Default How to Get Compensation for Water Damage from a Leak on Your Neighbor's Property

    If a neighbor has a water line rupture, and the water runs across their driveway and into the neighboring property owner's home, causing significant damage, are they liable for that damage? The neighbor's insurance company has offered to pay the homeowner's deductible, but says that it's a take-it-or-leave it offer, made as a good will gesture, and that if it's declined they won't offer any contribution of any sort in the future.

    If you can show that the neighbor's negligence caused or contributed to the water leak, you may have a greater claim -- but if you don't have evidence of negligence on the part of your neighbor (and their insurance company appears to believe that you do not), it becomes difficult to make any sort of claim based upon the unexpected water leak, even if it arose on their property. Further, if your insurance company is paying for repairs, any claim above the deductible becomes subject to their subrogation claim. While the full facts may change this impression, from what I know so far the offer of payment of the deductible seems like a good deal.
