    Default Can You Record a Call if the Other Person is Recording You

    If you're in a two party consent state, and you get a call from somebody (such as a bill collector) and they tell you or play a recording that they record all calls, or that they're recording the conversation with you, can you record them without informing them?

    Although laws vary by state, I do not recall seeing one with any such exception. Your consent to their recording you does not translate into their consent for you to record them. You should inform them of your intention and respect their wishes.
