    Default How to Find Out if a Non-Competition Clause is Enforceable

    If you sign a non-competition clause with your employer and, due to the deterioration of your employer's financial condition, are considering taking an offer with a competitor, how can you find out if a non-competition contract that you signed with your employer will be enforceable? How can you know if it applies to the new employer, or if it is unreasonable in scope or duration?

    To determine if a clause is likely to be enforceable and how it will be applied to a given job, take it to a business lawyer in your state for review. There is no way that anybody can evaluate contract terms without first reviewing the contract. Also, some states are much more skeptical of noncompete agreements than others, and outside of a business ownership context they're not enforceable in California; it's important to have the clause reviewed under state law.
