    Default Prosecution for Prescription Forgery

    My question involves criminal law for the state of: Oklahoma

    What should someone expect if charged for using forged prescriptions? Never been in any trouble prior, its been over a year since it happened and they have been sober for over a year.

    Who is the "someone" in this scenario? Is it you? And if not, what relationship do you have with the someone? (Your username suggests that you are the husband of the someone, but it's not totally clear, and clarity helps if we're to properly answer your questions.)

    Also, has the someone been formally charged by the police for forging prescriptions? If not, what has happened? More details are necessary.

    Some very serious concerns of jail. Depending on the facts, they are looking at at least one serious felony and possibly more.

    Here's one possible statute, punishable as a felony that carries up to ten years in prison and a fine of up to $10,000 for a first offense:
    Quote Quoting Oklahoma Statutes, Sec. 63-2-407. Prohibited acts G - Penalties.
    A. No person shall obtain or attempt to obtain any preparation excepted from the provisions of the Uniform Controlled Dangerous Substances Act pursuant to Section 2-313 of this title in a manner inconsistent with the provisions of paragraph 1 of subsection B of Section 2-313 of this title, or a controlled dangerous substance or procure or attempt to procure the administration of a controlled dangerous substance:

    1. By fraud, deceit, misrepresentation, or subterfuge;

    2. By the forgery of, alteration of, adding any information to or changing any information on a prescription or of any written order;

    3. By the concealment of a material fact;

    4. By the use of a false name or the giving of a false address; or

    5. By knowingly failing to disclose the receipt of a controlled dangerous substance or a prescription for a controlled dangerous substance of the same or similar therapeutic use from another practitioner within the previous thirty (30) days.

    Having a drug problem is not an excuse for breaking the law.
