Default Accidentally Taking a Landlord's Property

While living in an apartment, a tenant removed a wall-mounted heater because it was the summer months and the heater got in the way of their furniture. They put it into a box. Later, when moving out, they inadvertently took that box along with the many other boxes of their belongings that they were taking to their new home. Instead of contacting the tenant, the landlord called the police and reported that the heater was stolen. There is now a criminal warrant. What should the tenant do?

The tenant should work with a criminal defense lawyer, who can try to explain the mistake and arrange for return of the heater. A lawyer is going to be much better situated to deal with the police or prosecutor, in making that explanation, than is the tenant -- and anything the tenant says, innocent or not, can potentially be construed as evidence of guilt that could be presented in court.
