    Default Separation After Filing Form I-751

    An immigrant was married to a citizen and obtained a conditional Green Card. She has filed form I-751 to remove the conditions on her Green Card. However, her husband has now moved out and indicated that he wants a divorce. How will that affect the removal of conditions from her permanent residency?

    Assuming her I-751 was a joint petition, not much. If it was not a joint petition, she will need to seek a waiver of the joint filing requirement and will likely require assistance from an immigration lawyer. If she petitions for a waiver, she may be called in for an interview. With a joint petition, the petition will likely be granted without an interview.
