    Question Dispute over verbal agreement with car dealership Alabama

    I recently purchased a used car from a dealership here in alabama. There was a problem with the headlight, that he had promised to fix before i agreed to purchase the car. I signed a contract to purchase the car as is, but got his word on fixing the headlight. He tried a few times to get it fixed, but eventuallly found out that the car has to be taken to the dealership out of town to be fixed. This is where he told me that i'm on my own, and that he's not covering any more costs. I am wondering if I have grounds to take him to small claims court over this. I would think that since he tried to fix it, he knew there was a problem and told us he would fix it. please advise, thanks

    Take him to small claims court and see what the judge says.

    Of course, when he shows the judge that you signed the "as-is" agreement, it will weaken your case.

    On the other hand, when you show documentation that they unsuccessfully attempted to fix the headlights multiple times, the judge will have to decide if the car dealership made a verbal agreement to fix the headlight or if they were just being charitable on those occasions.

    (I've never known a used car dealership to be charitable unless it helped promote their business - i.e., adopt-a-road roadside cleanups, etc)

    I know the as is agreement will weaken my case, but wouldn't the proof that he had tried to fix it weaken his case? Is there any other information that I could gather that may help me win it?

    It could help you. Certainly, he could be asked to explain why, if there was no warranty, he was trying to repair the light. (He might answer, "As a favor, to try to make an unhappy customer happy.")
