    Default How Does the Only Heir Transfer Property Without Probate

    If a person is the only heir to a decedent in California, and the deceased person has only a few belongings and a car, how can those assets be transferred without probate?

    If the estate is small enough to fall under Probate Code, Sec. 13100, et seq., with the principal question being whether the estate's assets are valued in excess of $150,000, then the person can use California's small estate laws to handle estate assets without probate supervision. That includes the use of an Affidavit for Collection of Personal Property or Declaration under Probate Code 13101 to collect the assets from any third party who holds them, along with requires supporting documentation.
