My question involves landlord-tenant law in the State of: Kansas City, Kansas
I want to break my lease that has 4 months left on it due to issues with multiple neighbors smoking weed and the fumes coming into our apartment. I have a 6 month old son and I am concerned for his health and safety.I have called the police and reported the issues to the land lord MULTIPLE times. They all say there is really nothing they can do. Other issues in the building include criminal activity resulting in a police raid this past week, german cockroaches in the apartment (even though they have sent pest control multiple times), and people smoking cigarrettes and the smoke coming into our vents.
He moved in without seeing the place because we moved from out of state. Before even applying for the apartment, I asked over the phone if the apartment smelled like smoke because we have moved into apartments that smell like smoke before and its miserable. appartment management told us they had been in that apartment multiple times and it didn't smell like smoke. what seems now to be a blatant lie.
My landlord wants $2,000 in fees and rent to break the lease. I feel like we were lied to and misled when we moved into this place and I feel it is unsafe for my family. Am I at a loss because we have a signed contract? Do I have to pay these fees even though I don't feel like they are providing a safe place for me and my child to live?
