    Default What to Do if Unmarried Parents Disagree About a Child's Last Name

    My question involves name change laws in the State of: My concern is I let my daughter have her bio-fathers last name now I'm six months pregnant with his other child and I want the new baby to have my maiden but before I think about giving him mine I didn't think it would be right with them being full brother and sister having two different last names. If I change her name even with a child support case open because he's not willing to help as a father on his end and he's basically legitimized would that stop the child support case and what problems would it MIGHT bring? 😬

    You cannot change her last name without either his permission or the permission of the courts, and the courts are not likely to give permission if he objects. He can also fight you on the last name of the new baby...and he would have at least a 50/50 shot of winning that case.

    All in all, it might be more sensible to give the new baby the same last name as his sister.

    Even if he's never here for her or supplies anything for her. He hasn't help me for awhile and I can't do it all by myself including its not my new mans place to do it all.

    You are welcome to name the baby whatever you want. He has the right to take you to court to try to change it after he establishes paternity. What you likely won't be able to do is change the name of your first child to your name, and almost certainly not without the father's permission.

    The last name of your child has nothing to do with whether you can do it all yourself or not. And it isn't your new man's place to do any of it. So those two things are completely unrelated and have no impact on each other at all. What you can do, is file for child support and once paternity is established, and likely a shared parenting plan should Dad pursue it to help you financially. But you cannot count on child support, so you need to figure out a way to start being able to do it all.

    Wait.

    In your other thread, you say you're afraid that your 9 month old's feelings may be hurt because Daddy's latest is also pregnant (new baby). But you don't think your time will be split when your new baby arrives?
