    Default Access to Medications After Arrest

    A person was pulled over for DUI and, after testing 0.00, the police still arrested him and gave him a blood test, the results of which won't be available for quite some time. They booked him into jail. He had prescription medications with him, but they took them from him. He needs the medications for asthma and other medical conditions, and could have serious health complications without them. What can he do?

    He was arrested on suspicion of OUID so, even if jails did not as a matter of routine take prescription medications from arrestees before booking them into jail, there are plenty of reasons why the medications would not have been left in his possession. He needs to make sure that the jail is aware of his condition, providing them whatever information they may need to verify his condition, such that a nurse, doctor, or other qualified health professional can verify his need for the medication and arrange for a new prescription or for dosing of the existing medications.
