What makes you think there is a "plaintiff" or "service of process" in this action.
There is ALWAYS a "plaintiff" and "service of process" in both civil and criminal actions. In criminal actions the "plaintiff" is the State (or the people) and "service of process" is the delivering (whether by mail or in person) the "summons or citation" (complaint) to the defendant.
