    Default H-1 To Family-Based Green Card

    Hello,
    I'm currently in my 1-1/2 year of my 3-year H-1 visa. My mother became a permanent resident last year and she would like to make a petition for my green card. I found all the information needed to apply @ the uscis website but I have the following questions:
    1. In case the petition is denied, will that affect my H-1 status? and will I be able to renew it after my first 3 years?
    3. I understand that we can apply ourselves, but would you recomend applying with a lawyer?
    4. How long do you think it would take for me to get the green card? (approximately)
    5. Do you recommend that I make the petition for the green card through my employer? I understand it's a long and a little complicated process. I just don't want to get tied to a job (and I'm planning to relocate to another state), and if it takes the same time or less, then I'll apply throug my mom.

    Thank you in advance for all your help and guidance. I'll also appreciate any suggestions/tips for the process.

    It shouldn't affect your H1.

    Without knowing anything about your situation, I would suggest that you consult a lawyer and decide on the basis of that consultation whether you wish to proceed on your own or with legal help.

    I wouldn't want to guess. You can try Googling for personal accounts to see what other people have to say about their experiences and timing.

    That's something I would suggest discussing with the lawyer you consult.
