If a customer goes into a bar and they appear to be intoxicated, but they claim that they have only used marijuana and have a medical marijuana card, can the bar decline to serve the customer?
Yes. A bar is supposed to decline service of alcohol to a person who is visibly intoxicated. It doesn't matter if the intoxication results from prescription medications, street drugs, alcohol, or a combination thereof. Serving a visibly intoxicated person opens the bar up to liability for injuries subsequently caused by that person.
