    It wasnt false detention either she met both State laws and store policy for shoplifting stop! There was no false detention. I agree it "appears" to be innocent mistake but as I have said many times last few days LPs cannot read minds!

    No, do not give me that they can not read minds thing ! If a LP sees it was a innocent mastake then they should let someone go! I think alot of times LP's see a chance to take any way to make a stop and get the store one of those civil judgements for $50 to $500 .

    We are going to agreeto diagree then the LP does not know it was a mistake he/she may believe it but they dont know! Furthermore store policy may not allow them to let them go! I suppose your walking out of a store with a $500.00 TV was a mistake!? See the slippery slope that is!?

    Big , Big differance between cases. Good old Kmart LP's let me walk out with a $378.00 TV . Kmart LP"s admitted in their own written statements that they where told to stop me, they faild to do so. The police said if they, Kmart LP's, would have stopped me at the store that the whole thing would have gone better! So shame on me for what I did but, pie on the face of the LP's that failed to do their job !

    I used your story because you knew it my point remains the same if you stated it was accident you walked out door with $500.00 TV LP should take your word for it and let you go!? LP cannot read minds they have State Laws and Store Policies to guide them on their actions. Such was this case. LP and not the judge or jury its not up to them to decide who is guilty or innocent. The LP in this casefollwed both the Law and store policy and made a stop no charges appeared filed. This very same method is used countless times in real attempts to shop lift. It is unfortunate that this woman was stopped and asked to pay Civil Demand but as I have stated before she "might" be able to get Civil Demand removed. I have seen it done in this exact type of story.

    The batteries were less than six dollars. Oh, and I contacted the police department and I am safe. He said there was enough of a "grey area", that they let me go. (Even though the LP thinks he can commit no wrong-he doesn't make mistakes)
    I can't sue because of the stupid document I signed under emotional duress. The cop said to let it go, because even though the "shoplifting incident" is taken care of--if I pursue this, I try to prove my innocence, I could be given trespassing charges. He said not to take it personally, because this is their job, and it does happen to people. He said he has forgotten items at the bottom of the cart as well. One of my roommates who is a volunteer firefighter(emt)/former correctional officer asked one of his cop buddies who said the same thing--to leave it alone and that he had forgot items at the bottom of the cart too! I learned a lot from this experience; always be very careful. Even stuff I bring in to the store, I show it to the cameras or show the greeting person. No matter what he says, I have so many people who know me who could say I would never do this, no record(not even minor laws), good credit(my bills are often early!), etc. I know it's not his job to determine innocence or guilt--but he *did*. Several of my friends say, "Guilty until proven innocent.."

    Hopefully, in the future, there will be more avenues for people this happen to. Please don't forget, this could of happened to any of *you*. For those who say--they would never forget anything at the bottom of the cart? Neither did I until now--lack of sleep and not double checking this time cost me. Thank you very much everyone for listening, I really appreciated it. I am thankful nothing is going to happen to me for such an accidental error in judgement.

    I know it's hard (especially for LP's), but try to put yourself in the other person's shoes...(I am certainly not as naive or as ignorant of this sort of thing now!)

    (I was shocked that people use the bottom of the cart "excuse" who do truly shoplift or it was an accident. I learned it here, too!)

    But enough of this semi-incoherent, rambling post, I thank you again to everyone....

    Everyone have a nice day, and anyone who is innocent or those guilty who made a stupid lapse in judgement, you all have my prayers.

    Once again I feel I must say this. LP have rules to follow and steps to make stops those requirments were met! Where I agree it appears a mistake it was none the less a "good" stop. They did NOT determine you guilty! They detrmined you were removing merchandise from store (using a well know MO) without paying for it! They took the action required by store and Law. You were not charged! Yes accidents happen as I have described in another story but the LP did nothing wrong! They did NOT determine guilt they determined a theft was taking place (and it was unintentionally) they took a course of action that their employer tells them to take. I am sorry this happened and I am glad you will be more careful as this does happen more times than you relaize but you cannot fault LP for doing their job!

    Both of you are looking past the most important thing... THERE WAS A REASON LP WAS WATCHING HER.. from the time she selected the batterys to the time she did not pay for them along with her purchase. She must of showed some alert signals for them to watch someone that long. I have heard it all.. "I forgot", "it is my first time", "i will never do this agian" Well they do it on purpose... they have done it before and they will do it again. I only feel this way because i have been lied too again and again by shoplifters. So i do not see how she "forgot" and the lp happened to have all 5 of thier elements and knew the batterys where in the cart. If she wants to fight it.. go to her court date.. plead not guility and let the judge decide.. The LP did what they are supposed to do. I WOULD NOT have stopped someone for 6$ unless i have known them to have stole before. But that is because my company lets me decide what is in the best intrest of the company and not fault me for letting $6 out the door. BUT could she have been innocent..? SURE! Her story makes you want to believe her. And I am glad it worked out for you and charges where not filed by the police.
