    If I may chime in on this. I think if this person really believes he is not guilty and I think is not guilty. Then he or she should consider sueing Kmart. Thats right sue them for, I think, would be fasle arrest/ emotional damages. I think that would change Kmarts attitude fast. O yes when these LP's where trying to ram rod this person over $6 in batteries a real shoplifter or shoplifters where busy behind their backs getting out of Kmart! Now, what sense does it make to pursue one person over $6 when they have a whole store to watch .

    Which would take thuosands in Attorneys fees and about 1 to 2 years to complete! By the way it doesnt appear as though OP was arrested!

    Let me correct and say false detention. It is also easy to file a civil complaint without a attorney, but it does take time.

    It wasnt false detention either she met both State laws and store policy for shoplifting stop! There was no false detention. I agree it "appears" to be innocent mistake but as I have said many times last few days LPs cannot read minds!

    No, do not give me that they can not read minds thing ! If a LP sees it was a innocent mastake then they should let someone go! I think alot of times LP's see a chance to take any way to make a stop and get the store one of those civil judgements for $50 to $500 .

    We are going to agreeto diagree then the LP does not know it was a mistake he/she may believe it but they dont know! Furthermore store policy may not allow them to let them go! I suppose your walking out of a store with a $500.00 TV was a mistake!? See the slippery slope that is!?

    Big , Big differance between cases. Good old Kmart LP's let me walk out with a $378.00 TV . Kmart LP"s admitted in their own written statements that they where told to stop me, they faild to do so. The police said if they, Kmart LP's, would have stopped me at the store that the whole thing would have gone better! So shame on me for what I did but, pie on the face of the LP's that failed to do their job !
