    Default FMLA Eligibility Questions

    Employee anniversary hire date is March (this is Illinois)
    FMLA began in July - it's been intermittent and we're tracking it.
    She's used all her PTO in addition to her unpaid FMLA. So far she's been off 30 days.
    Q: Her anniversary is coming up; does her PTO kick in again and apply toward continuing FMLA?
    Q: She is going for major surgery soon and most likely will run beyond her eligible 12 week FMLA; do we have to grant an extension?
    She's a corp administrator and this is causing a hardship to our company...what additional rights do we have as the employer?

    She's a corp administrator and this is causing a hardship to our company...what additional rights do we have as the employer?Is this employee considered a key employee?

    Then when FMLA has been exhausted you have no further obligations under the law to hold her position for her.
