    Exclamation Concealed Weapons Charge For Gun In The Glove Compartment

    man caught with pistol in locked glove box, by undercover drug raiders, not registered to him, but llegally registered to his girlfriend. he was located in a known high drug trafficking area and was approached by undercovers and with him were to 18 year olds, both with possession of marijuana 1 under 5 grams and the other over 20 grams...the first man may only charged with possession on firarm with no concealed weapon to carry it. hes not a convicted felony, but currently in the drug court treatment (for first offense). is there anyway to fight it since the weapon is not stolen and is llegally registered and was locked (with ignition key) in the glove box? if charged, what would the maximum charges be that he may face?

    You can look up the statute here to find out what the maximum possible penalty might be. He was caught with drugs, and was in the possession of a concealed handgun? He had best hire a lawyer.

    what statute was he charged with? In FL it's not illegal to have a weapon in your vehicle as long as it is securely encased (locked glove box would suffice) and not on your person.

    see Fla Stat 790.25(5):

    POSSESSION IN PRIVATE CONVEYANCE.--Notwithstanding subsection (2), it is lawful and is not a violation of s. 790.01 for a person 18 years of age or older to possess a concealed firearm or other weapon for self-defense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Nothing herein contained shall be construed to authorize the carrying of a concealed firearm or other weapon on the person. This subsection shall be liberally construed in favor of the lawful use, ownership, and possession of firearms and other weapons, including lawful self-defense as provided in s. 776.012.

    Theres no gun registration in Florida.
