    Question Marriage to an Asylum Applicant

    Hello,

    I want to marry a girl who is a legal immigrant but is not yet a resident or citizen. She came on a tourist visa that was subsequently renewed, and is currently awaiting an answer on a political asylum request. I am not sure if I am allowed to make a petition for her to stay after we get married, or if we should just wait to hear the answer on her asylum appeal. I am concerned about what I have read about her possibly having to leave the country first and apply for fiance status because her life is in danger there (hence the asylum request). I don't know if we get married if I could then apply for her to stay as a "family member". Also, I'm not sure if we would be able to get permission to leave the country for a week for a honeymoon. Any advice would be appreciated

    hi...

    I have same condition that her....My husband is USC. I am asylee and have been denied for the individual court. In first appeal our lawyer filed for open the case and succeed. Now they r transferred my case to Boston and I am going to have my master hiring of the adjustment of the status next month. Just let u know my I - 130 have been approved and I had an interview last july....and they said that my marriage is bonafide. ( sorry for my english )

    She enters on a tourist visa, applies for asylum, and also quickly gets married? You're going to raise some serious questions with the USCIS as to whether the marriage is bona fide. But as I think Ciaobella means to suggest, if they decide that it is, the marriage would provide a basis to adjust her status. I suggest consulting an immigration lawyer.

    Just for your information:

    FIled asylum 9/2003
    Individual hiring denied 2/2005
    Married to US citizen 8/2005
    Filed I-130 12/2005
    Had interview 7/2006
    I-130 approved 1/2007

    Next month will be my master hiring for adjustment of the status. We should have faith. I believe as far as we came legal with inspection, not criminal, not marriage fraud.....should not be worry.

    My opinion is ..... when we r in other people country, we do not want to be hide and seek and become illegaly ( over stay ). We want to follow the law......that is why we applied asylum to make us feel secure to be here and we can work legally. I have many friends that got married with US Citizen and they got the GC so easy because they do not apply asylum. I looks that the law forgive those who r over stay or not registered themself in this country. I do not understand when the person who filled asylum and after got married with US Citzen it seems the situation become more complicated?
