Default Re: Can a Supervisor Write Lies on a Disciplinary Report

In the interim, hang in there. They are trying to force you into quitting, so there would be less chance you can be approved for unemployment insurance than if they fire you. Be looking diligently for something else, because you're definitely on your way out from the sound of this. But if at all possible, hang on there until you find another job or until they up and fire you, or until they announce they are cutting you to part time and cutting off your benefits or something major like that.

It's legal, it's possible, they can lie and make up things to write you up about. But keep careful notes of each conversation you have had and that you have from here on out with your supervisor and the dates of such conversations. If it comes up again that you've been written up before, ask for copies of these write ups. Any email conversation or directives or comments about your performance, print them off and make a copy of them right away. Take those copies home, so you will have them even if you are walked out of the office unexpectedly. That way if you are fired, you will have some structured account of when you and your employer had these talks, and the dates they happened. This will help you in an unemployment hearing, where they have to show that they had a valid misconduct reason to terminate you to keep you from getting unemployment (which costs them money) if they fire you.

So they'll try to get you to quit, which makes it much less likely that you will be approved for unemployment benefits. But hang in there. Treat them professionally, do your work quietly and with as little fuss as possible, do not bicker with your supervisor. It sounds as though you are working in a medical office, and usually those are the very worst, with office managers who often do hot have a clue about employment issues, but think they do. Yes, she can be a complete ass and can harass you, you'd have no case against her for harassment, there are no laws against it. And they could fire you "at will" just because they want to or based on false evidence or lies. But remember, don't let her goad you into quitting unless you have another job to go to.
