Default Consequences of Declining a Job After Agreeing to a Bond for Immigration Expenses

If a H1B employee signs a letter accepting a job and agreeing to pay a $5,000 fine toward the employer's immigration costs if they do not commence work on the agreed date, and then changes his mind about the job, can he inform the employer the very next day that he's not taking the job without having to pay any money?
