    Default How to Get an Inmate Prosecuted for an Assault

    A person was assaulted by another inmate when they were in jail. The jail ticketed the other inmate but the Sheriff's Department refused to treat it as a criminal matter. Now that the person is out of jail, can they get the other inmate prosecuted for battery?

    In some states a person can compel a prosecution by swearing out a complaint with a local magistrate, although they may be required to post a bond. It would make sense to consult a lawyer before taking such a step.

    The former inmate may try to discuss the matter with the Sheriff's Department or prosecutor's office.
