    Default Recovery of Excessive Bail

    A defendant in Texas was arrested without a warrant and a $10,000 bail was imposed. They got a bail bond to be released. They later discovered that the maximum bail for a misdemeanor is $5,000. (Texas Penal Code, Section 17.033). Their bail bonding fee was based upon the $10,000 amount. How can they get the additional fee back from the court?
