    Default Can CPS Put You On a Safety Plan Due to Prescription Medication

    A mother was prescribed Suboxone during pregnancy. When the child was born, she told them that she was on Suboxone so that they wouldn't be surprised by a drug screening. The child was placed on a safety plan while the mother found proof that the Suboxone was from a valid prescription. CPS then wanted to continue the drug test pending a second drugs screening. Is that permitted?

    A safety plan is often a voluntary measure, something to prevent CPS from having to take court action. If mom agreed to a safety plan, and is agreeing to its being continued, then that's all it takes to continue the safety plan.

    If mom does not want to cooperate, CPS will have to choose whether it is going to drop the matter or if it is going to file a petition in court to compel the mother to take specified actions, and potentially seeking state custody of the child.
