My question involves real estate located in the State of: California
I bought out my two brothers and one sister from their share of our childhood home which we were all four on the Grant Deed (no mortgage owed). My siblings signed their quitclaims last year and were paid by cashiers check and signed a "promissory note indicating they indeed were paid. Now I am attempting to sell my house and the sister is the only one who refuses to sign the Affidavit of Unsecured Title form. She has never talked with me since the day I paid her for her share (she wanted cash, but I refused..I would only pay by check through my credit union where the cashiers check was written. My brothers have told her to just sign the form, but she won't. What other form can I use so that escrow can be completed? I sent them the copies of the signed promissory note and they also have a copy of the original deed showing all four of us and the quitclaims by the three of them. Can she hold up the sale of this house from her willful, malicious interference with the sale of the property? What can I do? (or maybe the title company...)
