    Default Can You Sue Your Former Employer for Defamation Over its Termination Statement

    An employee was fired by his employer for an alleged conflict of interest. The employer later sent a statement to all of the employee's former co-workers stating that the termination was for "conflict of interest" and explaining what happened. The employee believes that people will hear that he was terminated for a conflict of interest and assume that the termination was for financial impropriety or misuse of company information or resources. Can the employee sue for defamation?

    Defamation cases are predicated upon a lack of truthfulness. The employer provided an explanation (that appears to have been truthful) that would remove any question as to why the employee was fired. The employee may not like the fact that somebody might misinterpret the term "conflict of interest", or assume a different set of facts than the employer provided, but that does not mean either that "conflict of interest" is an inaccurate description of what occurred nor does it change the fact that the employer provided facts that would remove any ambiguity from the employer's actual statement.

    So as it stands, I don't see a basis for a defamation case.
