The employee works in a union shop, so the first thing he should do is speak to his union representative about the issue. The union may take care of the matter for him.
If the union cannot or will not address the issue, the man should consult a plaintiff-side employment lawyer about his options, for a review of the apparent FMLA violation based upon the full facts of the case. If the union makes findings, it will be helpful for the lawyer to review those findings.
Ideally, the union will resolve the issue without the need for any further legal review or legal action.
