An employee in a union shop went out on approved FMLA leave for six weeks after the birth of his child. When he returned, he was told that his supervisory role had been filled, and that he was not being returned to that position. He was instead demoted to the non-supervisory position he had held before his promotion to supervisor. When he asked why, the employer stated that there were changes in direction for the plant, but no other positions have been changed or altered. The job description for the supervisor position is unchanged.
What should the employee do?
