Default Is a Former Employer Liable if it Refuses to Verify Past Employment

A job applicant is a finalist for a new position, but the employer first wants to verify his employment history. He left a former employer on less than ideal terms, and that employer is simply ignoring the new employer's requests for information or verification even of his starting and ending dates. Can the former employer be sued for failing to provide that information if it costs the applicant the job opportunity?
