    Default Discrimination in Video Monitoring of Employees

    A company's fleet of trucks was set up with a video monitoring system (DriveCam) through which employees could be monitored to make sure that they were doing their job duties. The company expanded its fleet to include new trucks, but did not install the monitoring system in the new trucks. Is it legal for the employer to monitor only those employees who drive the older trucks, even though the employees in the newer trucks aren't subject to monitoring and could be engaged in inappropriate conduct without being caught or disciplined?
