    Default Can an Employer Require Participation in a Health Insurance Wellness Program

    Can an employer require that employees participate in a wellness program, through their health insurance, or pay a surcharge? Employees who are flagged for the program must undergo wellness programming with a nurse until the plan decides that they should be discharged from the requirement, and if they choose not to participate they have to pay a significant monthly surcharge on their premiums.

    Yes, such a program may be lawfully implemented. The goal, of course, is to reduce employee healthcare costs.
