    Default Will Was Never Changed

    My mother died a week ago, i am the oldest son. Some years back we got in a argument, and she took me off her will. She eventually got over it, but became ill. She asked me if i would donate a kidney, of course i said yes. We were tested and became a match. Over the last several months i took a lay off from work, so we could do the kidney operation. She never got well enough to make it.
    Upon opening the will it was never changed. Her husband said, "we always ment to change it, but never did." My sister and brother had the power to protest it, but would be taken off the will if they did. So they didn't. I never wanted anything from my mom, only for my daughter (her grand daughter), and that was promised by mom.

    What do i do? Can i protest?

    If it's not in writing [taking you off the will], it never happened. Consult with a Probate Attorney, and not with any attorney representing/hired by the Executor.

    You can contest the will and hold it up for several years. Since the others are probably anxious, they may agree to a settlement. Go to the probate court and get a copy of the file. Then make an appointment for a consultation with an estate attorney. If your mother promised to repay you for your time and effort, you can file a claim against the estate.
