    Angry IRS collecting back taxes

    My husband and I were married in 04. Most of our income was mine for that year. I filed a joint return but all of my refund was taken to cover back taxes of my husband's from 1987! Is there a time limit where they can collect this? Also the code CP42 doesn't exist on their website and the form does not tell us what the balance is just that they applied the entire refund to the back taxes from 1987. Is there any way I can get this money back?

    A simple phone call can get you the balance and there is no limititation on how long they can take to collect. Be thankful they havent put a lien on your property or wage garnishment. I owe well over 10 grand to IRS for past mistakes and entered a pay plan as well as them taking my refunds that was paid off in 04 thank God

    I thought I had read somewhere that there's a 10 year limit, maybe I read that wrong. Apparently 04 was the last year to cover what was owed because they did not take last year's tax refund. Also, what would be involved in amending that return and filing an injured spouse?

    Go see a tax pro ASAP. You can still file an injured spouse form to get back your share of the refund....however you really shouldn't have waited so long to do so. Also, if you intend to stay married, then it may be in your family's overall best interest to leave it be, and to get your husband's tax debt paid off asap.
