    If the trunk of a dead tree crosses the property line between two homes, do both homeowners have to share equally in the cost of removal?

    If the tree is dead but not dangerous, and one neighbor wants to remove the tree but the other does not, then the neighbor who wants to remove the tree can expect to pay for its removal.

    If the tree is dangerous, depending upon state law, the neighbor who removes the tree may have a cause of action for contribution against the neighbor who would not contribute to removal -- but the neighbor who removes the tree had best be prepared to prove the dangerousness of the tree with the testimony of a qualified arborist. The cost of litigation could easily exceed half the cost of tree removal.
