Can someone be charged with home invasion if they were invited to stay the night and was in the home when they took something from the home and pawned it?

A typical home invasion statute requires the entry into the premises to be unlawful. However (1) the answer depends upon the language of the governing statute, and (2) no matter what the defendant claims, if the homeowner denies extending an invitation a prosecutor may well charge home invasion anyway.
