Default Use of a 911 Call in a Criminal Prosecution

If there is a recording of a 911 call, why wouldn't a prosecutor use the recording at a defendant's criminal trial?

Default Re: Use of a 911 Call in a Criminal Prosecution

There are many reasons. Perhaps the content of the call is wholly or partially inadmissible under the rules of evidence. Perhaps it doesn't contain anything relevant to the issues before the court. Perhaps the judge has reviewed the recording and found it to be more prejudicial than probative. Perhaps it's duplicative of other evidence and the prosecutor prefers live testimony. The list goes on.
