    Default Expungement in progress - what do I answer on the employment application?

    I am having a misdemeanor shoplifting case expunged in NJ, I was not convicted of anything, the case was officially dismissed by the judge in Municipal Court (Paramus, NJ).

    The papers went to court on Friday, 2/2/07 for approval. I don't know how long it will take to notify the appropriate people to seal my arrest record.

    My question is: What should I answer on the employment application if it asks whether I have been arrested? It has only been one business day since the expungement request was approved.

    Any information will be useful. Thanks.

    I know I should answer truthfully, but I don't want this incident to reflect badly on my chances to get the job. I am applying for a position at one of the top bulge bracket investment banking companies in NYC.

    Being that I am in "limbo" since the record has been expunged but may not have been updated in all the appropriate databases, etc. Do I have to say that I was arrested? Like I mentioned, the shoplifting charges were subsequently dismissed by the Judge.

    If the arrest does come up in the background check, can I explain that the record should have been expunged and I didn't have to report it on the application?

    Does anyone have any idea how long it takes for an expungment to take effect once it's approved?

    I have not submitted the application yet.

    Even if it is submitted into the system, that doesn't mean it still will not come up on a background check--not all are created equal and I have seen expungments, dismissed, and cases that were 25 years old come up when you don't think they will. If this case was years ago and you have been clean since, I would think that the length of time would be taken into consideration---Again be honest because if you fail to put it down and it surfaces, you will get nailed for falsifying an application.

    Most employers would not ask about an arrest, and from what you say you were not convicted of any crime.

    Here are the facts:

    - Arrested (handcuffed & fingerprinted) at Paramus Police Station in NJ
    - Case officially dismissed by the Judge
    - Requesting expungement for the arrest

    How do I answer these questions on an employment application:

    1) Have you accepted a disposition of adjudication withheld on any criminal charge?

    2) Have ever been convicted of a crime?
