    Default Can the Police Conduct Probation Searches After You Move

    A man on probation rented out his house to his girlfriend, then moved to a new address. The police came to the house several weeks after he moved, along with his probation officer, and insisted upon searching the premises. They were told he didn't live there any more, and they said that it didn't matter -- that they could search his home at any time. Is that correct?

    It sounds like the man did not update his address with probation, such that his house is still his official residence. It may also be that his probation order includes his having authorized searches of that home, without regard to who supposedly lives there. If it's a matter of his not updating his address, he should do that -- keeping in mind that it may not be enough to convince the court or probation officer that the lease is a bona fide, arm's length transaction and that he's not living at the home part or most of the time. If it's a matter of his having authorized searches of the home throughout the term of his probation, he should discuss his options with a criminal defense lawyer.
