    Default Can a Minor Get Emancipated and Get Custody of a Younger Sibling Due to Abuse

    My question involves juvenile law in the State of Tennessee. I am 16 in Tennessee and wish to be emancipated because of abuse within my family and wish to bring my little sister with me. I have a job but am not living away from my parents. I plan to finish school and go off to college. My twin is also 16 and could get emancipated too and we could move in together and get an apartment. My question is what is the likelyhood of me and my twin being emancipated and us being able to legally take my little sister with us and would we be able to take her.

    The likelihood of you and your twin being emancipated is zero.

    If you are being abused, call CPS or speak with your school counselor.

    I can't. I've read the statistics on family cps problems. The likelihood of me and my sister's staying together is little to none. I won't can't leave them alone. I'm all they have. They're all I have.

    That's your legal option.

    (And you're actually mistaken; keeping siblings together is often the preferred option wherever possible).

    Emancipation is not and never was intended to be a means to allow a minor to leave a bad situation. It was and is intended to be a means of providing legal protections to those minors who, through circumstances outside their own control, found themselves living alone.

    Either the abuse is bad enough to warrant removal or it's not. If it's only bad enough if you get to control what happens and where you go, then it's not bad enough to support an emancipation claim. Even if the state would emancipate you on that basis. Which they won't.
