    Default Can a Tourist Marry a Permanent Resident and Stay in the U.S.

    If you are in the U.S. on a Green Card and your fiancé enters the U.S. on a tourist visa, if you marry in the U.S., can your fiancé stay in the U.S. or do they have to leave when their authorized stay is over?

    You cannot seek adjustment of status of your spouse if you are a permanent resident, so if your fiancé were to overstay he would be setting himself up for a lot of immigration problems down the road.
