    Default Defending Against Simple Possession of Drugs if the Drugs Aren't Yours

    A person is charged with simple possession of a controlled substance over prescription medications. The medications were being held for somebody else. How can the person get the charge dismissed? This is in New York.

    Talk to your lawyer. It's likely going to be difficult to convince the prosecutor that the medications belonged to somebody else and, under typical state law, that's not actually a defense to the crime.
