    Default How to Defend Against a False Trespassing Charge

    If your former employer and a number of its employees report to the police that you were trespassing on the employer's property, and as a result you're arrested and charged with trespassing, can you sue them for making a false report?

    You can discuss your options with a lawyer in your state.

    In simple terms, if you go to your former employer's premises after being told not to come back, or go there and get in an argument then refuse to leave when you are told to leave, you can face potential criminal charges for trespass. If for some reason your employer is falsely claiming that you were present when you were not in fact at their premises at all, claims to have given you a trespass ban that was in fact not issued, or claims that you were told to leave in relation to the incident underlying the request and you in fact promptly left or contend that no such instruction was given, your lawyer can help you identify possible sources of evidence that may help with your defense.

    If your former employer has any surveillance or security video on its premises, it is important that your lawyer try to secure the video and the request be made before any video files are deleted.
