    Default Signing Over Rights to a Child Following Denial of Access

    The custodial parent, the mother, has litigated continuously against the father, causing financial hardship. He rarely sees their child despite paying his child support. Mom keeps taking him back to court for more child support. Can he sign his parental rights over to the mother to end all of this?

    If mom has proposed stepparent adoption, dad can consent to the adoption.

    If not, then dad can "sign away his rights" in the sense of giving up any right to physical or legal custody, but he can expect to continue to pay child support.

    Few states allow a parent to terminate the rights of the other parent in the absence of a stepparent adoption, most that do will not authorize termination unless there are grave reasons to do so (abuse, long-term incarceration) or in anticipation of adoption, and none will do so against the wishes of the custodial parent.
