    Default Age of Majority When Moving to Mississippi at Age 18

    My question involves juvenile law in the State of: Mississippi.

    I turn 18 in two months and I planned on moving to Mississippi to be with my boyfriend and his family(i know them in person, he moved). my family doesn't want me around and my mother, whom i live with is emotionally abusive. She calls me names, tells me nobody likes me when they get to know me, screams at me if i hang out with a family that isnt her, stalks me if i try to go to the park with friends, says im incapable of things etc.
    she wants guardianship of me so i stay with her forever, she thinks the anxiety and depression that occasionally hit and only when shes screaming at me - make me incapable of taking care of myself though when i apply for jobs she wont bring me and i cant drive because no license or vehicle. i have no other family that care considering theyre just like her. problem is, age of majority is 21 in mississippi and im in new jersey where it's 18. i'd be living with adults, attending schooling whether it be homeschooled or other, and fully capable of getting a job and growing as a human being. there's no way my mom wouldnt make things worse if i left and had to come back due to some type of legal thing? i'm scared and tired of being here and just want to be happy and I feel like emancipation is my only option. thanks!
    my questions are:
    1)Can I file for emancipation if she's in a different state and If so, Can I still stay with my boyfriends family or a friend while it goes through and possibly after if it goes through?
    2)Can she file for guardianship if I no longer live with her?
    3)Is it illegal to not be the age of majority and live with someone who isnt my legal guardian?

    That is an interesting situation. It would not be illegal for you to leave New Jersey when you turn 18, because in New Jersey you would be a legal adult. You would not however, be a legal adult in Mississippi. It would not be illegal for you to live with other legal adults, but you could run into some complications because you would not be a legal adult and no one would have guardianship of you. You would have to live in Mississippi for at least six months before jurisdiction in Mississippi would be established. At that point you could file for emancipation.

    For most purposes, Mississippi treats 18-year-olds as adult. They cannot be charged with status offenses, such as running away from home. They are able to enter into binding contracts. They are treated as adults by the criminal justice system.

    Unless you have a specific task that you want to perform, that Mississippi won't let you perform because of your age with no other legal bypass available, there's no need for guardianship or emancipation through the courts. If somebody wants to file for emancipation in Mississippi, they must first establish domicile in that state.

    The issue of guardianship in New Jersey at age 18 arises if you are legally incapacitated by mental illness. That's not age-related -- if a person is legally incapacitated, they may become subject to guardianship proceedings at any age.

    Are you under the care of a psychiatrist ? If you don't have a high school diploma and aren't enrolled in school in Miss, you may find it difficult to get a job.
